Preamble — Identification and transparency
This Legal Notice identifies the publisher, the publication director, and the main technical providers of the Fraquane digital ecosystem.
It applies in particular to the ps.fr portal, the shop.ps.fr store, the account.ps.fr customer area, and the domains operated by Fraquane that provide access to its universes, pages, collections, or services.
It is established in accordance with French rules applicable to online public communication services, notably the loi n° 2004-575 du 21 juin 2004 for trust in the digital economy, known as LCEN.

The publication director is Orlando SEGOND-RAYNAUD, as the legal representative of Fraquane SAS.
They assume editorial responsibility within the limits provided by applicable regulations, without prejudice to rules specific to content published by third parties.

Article 4 — Hosting of the Fraquane infrastructure
The technical infrastructure of Fraquane, including dedicated servers and resources necessary for the general operation of its ecosystem, is hosted by:

Scaleway acts as the host of the Fraquane infrastructure. This role is different from that of the publisher, which remains Fraquane SAS, and from the technical roles assigned to Shopify and Cloudflare described below.
Article 5 — Shopify Platform
The sites ps.fr, shop.ps.fr, and account.ps.fr are operated using the Shopify platform for the presentation of content and products, the online store, the ordering process, and customer account functions.
The contractual provider indicated is:

Shopify provides the application and commercial platform. Shopify is not presented in this Legal Notice as the publisher of Fraquane or as the main host of the Fraquane infrastructure.
Article 6 — Domains, Security and Cloudflare Programming
The technical management of all Fraquane domain names, including DNS configuration, routing, CDN distribution, reverse proxy, caching, TLS/SSL certificates, WAF protection, and network security measures, is provided through Cloudflare services.
Programming and execution functions deployed on the Cloudflare layer, including rules, redirects, Workers, and associated routing mechanisms, are also managed by Fraquane using this platform.

Cloudflare acts as a provider of network infrastructure, domain management, certificates, and security services. Its involvement does not confer the status of publisher of Fraquane content nor that of the main host designated in Article 4.
Article 7 — Access to the Site
Fraquane strives to ensure the accessibility of its services but does not guarantee continuous operation, error-free functioning, or compatibility with all devices.
Access may be suspended for maintenance, security, updates, incidents, overload, provider intervention, or force majeure. Fraquane strives to limit interruptions that are reasonably foreseeable.
Article 8 — Nature of Published Information
The content presents the ecosystem, products, services, features, commitments, and legal information of Fraquane. They are provided for informational purposes, except when they constitute a contractual offer or mandatory pre-contractual information.
The features, prices, availability, and conditions applicable to an order are those displayed in the sales process and specified by the General Terms and Conditions of Sale.
Article 9 — Accuracy and Updates
Fraquane takes reasonable care to ensure the accuracy of the published information. However, errors, omissions, technical developments, or modifications by a supplier may occur.
Manifestly incorrect information must not be exploited in bad faith. Any anomaly may be reported to support@ps.fr to allow for verification and correction.
Article 10 — Intellectual Property of Fraquane
The structure, design, texts, logos, distinctive signs, illustrations, photographs, videos, animations, sounds, databases, graphic elements, codes, and original content belonging to Fraquane are protected by applicable intellectual property rights.
Except with written authorization or legal exception, any reproduction, representation, adaptation, substantial extraction, dissemination, commercialization, or exploitation is prohibited.
Article 11 — Trademarks and Distinctive Signs
The names Fraquane, "Beyond the Game", the logos, emblems, visual universes, service names, and domain names used by Fraquane may constitute trademarks, trade names, signs, or protected marks.
No license is granted merely by consulting the content. Any use that could create confusion, suggest a non-existent partnership, or harm the reputation of Fraquane is prohibited.
Article 12 — Third-Party Trademarks and Content
The trademarks, games, consoles, studios, clubs, manufacturers, products, images, or works of third parties remain the property of their respective holders.
Their presence may serve to identify a compatible product, a category, news, or a commercial universe. It does not imply any affiliation, approval, license, or official partnership, except where explicitly and verifiably indicated.
Article 13 — Authentic Products and Supplier Information
Product information may come from manufacturers, distributors, suppliers, or partners. Fraquane adapts and controls this information as reasonably possible.
Legal warranties, information obligations, and consumer rights are not limited by the fact that initial content comes from a third party.
Article 14 — Access License
Fraquane grants the User a personal, limited, non-exclusive, revocable, and non-transferable license to view the pages and use the functions for their legitimate needs.
This license does not authorize automated extraction, resale of data, mass copying of the catalog, creation of a competing service, or circumvention of technical protections.
Article 15 — Incoming Hyperlinks
The creation of a simple link to a public page is generally permitted if it does not infringe the rights of Fraquane, does not mislead the public, and does not incorporate the content in a way that suggests it belongs to a third party.
Fraquane may request the removal of a link used in an unlawful, misleading, parasitic, defamatory, or harmful context.
Article 16 — Links to Third-Party Websites
Pages may contain links to services, social networks, manufacturers, carriers, payment methods, or third-party partners.
Fraquane does not continuously control their content or practices. The User must review their terms and policies. The presence of a link does not constitute a general guarantee or approval of the entire third-party service.
Article 17 — User-Published Content
When a space allows a review, comment, message, or other content, the User remains responsible for what they publish and must comply with the law, the rights of third parties, and platform rules.
Fraquane may moderate, hide, or remove content that is manifestly illegal, fraudulent, abusive, counterfeit, misleading, unauthorized advertising, or contains personal data exposed without necessity.
Article 18 — Reporting Illegal Content
A report may be submitted to support@ps.fr. To allow serious processing, it must identify the content, its exact address, the legal grounds, the date of observation, the requester's identity and contact information, as well as any supporting evidence.
Abusive, incomplete, or clearly unfounded notifications may not result in removal. Fraquane may forward a request to the competent authorities or service providers when required by law.
Article 19 — Cybersecurity
It is prohibited to disrupt services, introduce malicious code, bypass authentication, test a vulnerability without authorization, extract data, overload infrastructures, or impersonate a third party.
A security flaw discovered in good faith must be reported confidentially to support@ps.fr, without exploitation, premature public disclosure, or excessive access to data.
Article 20 — User Responsibility
The User protects their credentials, verifies the accuracy of the information provided, and uses the services in accordance with the law and contractual documents.
They are responsible for the direct consequences of their unlawful acts, for compromises resulting from their negligence, or for fraudulent use carried out by themselves, subject to applicable mandatory rules.
Article 21 — Limitation of Liability
Fraquane is only liable for damages that can legally be attributed to it. It cannot be held responsible for damage resulting exclusively from a third party, improper use, unreported incompatibility, an external network, or an irresistible and unforeseeable event.
No clause limits statutory warranties, liability for gross or willful misconduct, bodily injury, or the rights that a consumer cannot waive.
Article 22 — Force Majeure and External Events
Fraquane is not responsible for non-performance caused by an event meeting the legal criteria of force majeure. The service may also be temporarily affected by: general outages, major cyberattacks, operator failure, disaster, conflict, administrative decision, or critical infrastructure breakdown.
Fraquane implements reasonable measures to limit the effects and restore its services.
Article 23 — Personal Data
Fraquane processes personal data to manage accounts, orders, payments, deliveries, requests, security, legal obligations, and, depending on choices, communications or personalization.
Purposes, legal bases, recipients, durations, transfers, and rights are detailed in the Privacy Policy. Requests can be sent to support@ps.fr.
Article 24 — Cookies and Trackers
Strictly necessary trackers may be used without consent for the cart, session, security, language, or essential preferences.
Non-essential trackers are subject to consent when required. The User can accept, refuse, or modify their choices using the designated manager. Details are provided in the Cookie Policy.
Article 25 — Separate Contractual Documents
The Legal Notices identify the website actors but do not replace:
- the General Terms and Conditions of Sale;
- the General Terms and Conditions of Use;
- the General Terms and Conditions of Services when applicable;
- the Privacy Policy;
- the Cookie Policy;
- delivery, return, and refund policies.
Each document retains its own purpose and must remain accessible separately.
Article 26 — Consumer Mediation
Information relating to the consumer mediator effectively appointed by Fraquane is included in the General Terms and Conditions of Sale and the media provided for by law.
No body should be presented as a mediator without a valid agreement with Fraquane.
Article 27 — Applicable law
The Legal Notice is governed by French law. This stipulation does not deprive a consumer of the more protective mandatory provisions of his country of residence when they are applicable.
Any dispute follows the rules of jurisdiction provided for by law and the relevant contractual documents.
Article 28 — International Accessibility
The ecosystem is offered in multiple languages and across multiple domains. Content can be adapted to a country, language, currency, or category without changing the publisher's identity.
The French version of the Legal Notice is the reference version, subject to mandatory rules. An unknown locale must display the English version and never automatically revert to French.
Article 29 — Update of the Legal Notice
Fraquane may update this information to reflect a change in its capital, headquarters, management, contact details, hosting provider, infrastructure, applicable law or digital organization.
The date of the update is at the top of the page. Mandatory information must be corrected without a reasonable delay after it has been officially changed.
